How is a divorce settlement calculated in the United States?+

Divorce settlements depend on whether your state is a community property state (≈50/50 split of marital assets) or an equitable distribution state (a fair, but not always equal, split). Courts also consider marriage length, each spouse's income, separate property, child custody, and contributions to the marriage. Our calculator estimates a likely range based on these factors.

What is the difference between community property and equitable distribution?+

Nine states (Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, Wisconsin) follow community property rules — marital assets and debts are typically divided 50/50. The other 41 states follow equitable distribution, where a judge divides assets fairly based on multiple factors. Equitable does not always mean equal.

How is alimony or spousal support determined?+

Alimony is more likely when there is a significant income gap (often 30%+) between spouses and the marriage lasted at least 3–5 years. Courts consider income disparity, marriage length, age, health, and earning capacity. A common rule of thumb: support equals 20–30% of the income gap, paid for 30–50% of the marriage length.
